RULES AND REGULATIONS FOR A REALITY SHOW TENTATIVELY TITLED “RAAZ...PICHALE JANAM KA” Part A: Program - “Raaz...Pichale Janam Ka” (tentatively name) 1. NDTV Imagine Limited (“Company”) intends to broadcast a reality program tentatively named “Raaz...Pichale Janam Ka” (“Program”), which will be organized, managed and produced by The Ideas Box Entertainment Private Limited (“Producer”). 2. The Company together with the Producer will be producing the Program which is based on the concept of Past Life Regression (hereinafter “PLR”) wherein the participants undergo the PLR process as a part of the Program. PLR is a technique that uses suggestions, counselling etc. by a qualified therapist to recover what most practitioners believe are memories of past lives or incarnations. The objective of the PLR process is to enable the participant to relive the memories of his/her past life and to visualize experiences and events from his/her past life. 3. The participation of any person in the Program shall be governed by these rules and regulations. Therefore, an adult person interested in taking part in the Program and undergoing the PLR process as a part of the Program may choose to participate in the Program after reading these rules and regulations carefully. Participation in the Program is voluntary and is at their sole discretion. Submission of the registration request shall be considered as acceptance of these rules and regulation. Part B: Registration Procedure to participate in the selection process 1. Eligibility Criteria: 2. The Program shall have many levels, the first level commencing from inviting entries and registration. 3. The registration process shall commence from 23rd October, 2009 and end on 30th November, 2009 (“Registration Period”). 4. The Applicant(s) is free to register by calling on the landline number (91) (022) 26000033; (i) The Applicant(s) can call (91) (022) 26000033. The Applicant(s) are required to provide personal information/information as part of the registration which shall be asked by the authorised representative of the Company/Producer or such other third party appointed by the Company/Producer during the call. During such call the Applicant(s) is required to share his experiences and explain his reasons to participate in the Program and undergo the PLR process. (ii) The language of communication during the registration stages shall be Hindi and/or English (ii) The telephone lines for accepting entries through the landline number shall be open on all days during the Registration Period between 11:00 a.m. (Indian Standard Time) and 11:00 p.m. (Indian Standard Time), except on 23rd October, 2009. The telephone/land lines on 23rd October, 2009 will open at 7.00 p.m. (Indian Standard Time) and close at 11:00 (Indian Standard Time) p.m. For callers from Mumbai, Local call rates shall apply. For callers outside Mumbai, the Subscriber Trunk Dialling (STD)/International Subscriber Dialling (ISD) rates shall apply according to the caller’s location. 5. Neither the Company nor the Producer nor any persons appointed by the Company/ Producer in this regard, shall be responsible for any kind of network problems and/or breakdown of machinery and/or technical problems and/or technical snags and/or unclear network and/or disconnection/disruption during calls and/or internet usage and/or costs charged by the network provider/internet service provider etc. Any dispute in connection to the same should be settled between the subscriber and the network operator/internet service provider directly without involving the Company or the Producer or any persons appointed by the Company/ Producer in this regard. 6. Once the Application is submitted by the Applicant(s), it shall deemed to be construed that the Applicant(s) has voluntarily agreed to participate in the Program without any undue pressure from any third party including the Company/Producer, the Applicant(s) has carefully read these rules and regulation and promised to abide by the rules and regulations and the Applicant(s) has personally provided accurate information/filled in the registration form. 7. Registration by the Applicant (s) is the first step towards the selection process for the Program to become one of the participants in the Program. Neither the Company nor the Producer guarantees the registration of each and every Applicant(s) or selection of the Applicant to the next stage(s) of the Program or guarantee that the Applicant(s) would be selected as a participant in the Program. The Company and/or the Producer and/or any persons appointed by the Company/Producer shall scrutinize, screen and verify the applications received and, at the sole discretion of the Company/Producer, shortlist the Applicant(s) who are eligible to participate in the further rounds of the Program. The Company and/or the Producer and/or any persons appointed by the Company/Producer shall have the sole right to decide the Applicant(s) who shall be eligible to participate in the further rounds of the Program (“Shortlisted Participant(s)”). 8. The Shortlisted Participant(s) will be contacted by the Company and/or the Producer and/or any persons through the Company and/or the Producer through the contact details or the e-mail address provided by the Applicant(s) during registration. Thus, it is important for the Applicant(s) to ensure that the contact details and the e-mail address are correctly provided at the time of registration failing which the Company/Producer will not be able to inform/contact the Applicant(s). If successful contact is made and in case the Company and/or the Producer conduct an audition the Shortlisted Participant(s) shall be asked to be present for the audition process. The Company/Producer shall not call or inform the rejected Applicants, to inform them that they have not been selected for the Auditions process. 9. In case if there are any further rounds of audition and the Applicants is selected for the same, then the cost and expenses in connection to travel, stay etc., for the audition process shall be solely borne by the Shortlisted Participant(s). Part C: Standard Rules and Regulations of the Program 1. The Applicant should apply and/or participate in the Program only after obtaining consent from the family members and after consulting or seeking advice and consent from their doctors/professional advisors. 2. During the PLR process, Shortlisted Participant shall be asked various questions by qualified psychoanalysts/therapists who may help the Shortlisted Participant to relieve the memories of his/her past life and to visualize experiences and events from his/her past life through the PLR process. It is clarified that, neither the Company nor the Producer nor their officers nor any persons involved in connection to the Program should be held responsible by the Applicant(s) or any persons related to the Applicant(s), if the participant does not respond to the PLR process or fails to get regressed due to any reason whatsoever or his/her reasons to undergo the PLR process is not accomplished. 3. Neither the Company nor the Producer claim nor guarantee cure of any ailment/disease/mental and psychological problems (such as phobias, fears etc.) through such PLR process. 4. In case the Applicant is selected to participate in the Program, on the day of the actual shoot, the selected participant is also required to bring his/her family and friends. It is once again clarified that the Shortlisted Participant is required cooperate fully with the therapist before as well as during the shoot in order to meet the requirements of the PLR process. This entire process will be shot/ filmed by the Company to be included in the episode/(s) of the Program. The Participant acknowledges and agrees that the Company and the Producer shall have the right to create and/or use and combine any third party footage and/or clip(s) (whether from film(s) or otherwise), along with the footage shot by the Company wherein the Participant has rendered his/her services to create episode/(s) of the Program. Participant agrees and understands that only the Company shall have the sole right and discretion to take any and all creative decision related to the Program including without limitation to whether to create episode(s) out of the footage shot with the participant, the third party footage/clips used along with the footage shot with the participant, etc. The Participant understand and acknowledges that the Participant will not have any say in any element of the episode/(s) of the Program. Participant also understands and agrees that the episode/(s) of the Program shot and filmed by the Company shall be commercially exploited by NDTV Imagine Ltd. The Company shall have the right to create, modify, edit alter the footage wherein the Participant has provided his/her services and the Participant shall have no objection to the same. 5. The participant undertakes that he/she has understood the entire concept of the Program. The participant, without any coercion and/or undue influence and at his/her own will, and his/her sole risk agreed to participate in this Program and undergo the process PLR. The act of the Applicant(s) of participating in the Program, shall be deemed to be construed as a waiver given by the Applicant(s) and all the person(s) associated/related to Applicant(s) to exercise his/her rights (if any) to issue/file in person and/or through any family member and/or any third party any notices, applications, suits, litigation, complaints, claims in any court(s) or forum/fora against the Company/Producer or their officers or any persons involved in connection to the Program and/or any selection procedure or for any claims or reliefs or otherwise. 6. The Company/Producer shall be free to, at any stage/level of the Program, exclude the Applicant(s)/Shortlisted Participant(s) from further participation in the Program, if the Company/Producer/any third party appointed by the Company/Producer finds that the Applicant(s)/Shortlisted Participant(s) failed to provide any information and/or hide any information and/or provide wrong information and/or misrepresent any facts. 7. Any information (personal or otherwise) provided by the Applicant(s)/ Shortlisted Participant(s) at any time during the various stages of the Program including at the registration stage, selection stage, etc., should be in good taste, non-derogatory, non-defamatory and should not be violating any law or social/religious norms etc. At any stage of the Program, it is found that the photograph(s), video(s) or any information (personal or otherwise) provided by the Applicant/ Shortlisted Participant(s) is inaccurate or derogatory or causes any offence or violates any laws or is/may not be socially/religious acceptable etc., the Company/Producer reserves the right to reject such Applicant(s) and the application form filed by such Applicant(s) and/or disqualify such Applicant(s)/ Shortlisted Participant(s) from further participating in the Program. 8. The Applicant(s) shall ensure that the Applicant(s) family member/relatives/ acquaintance/ friends will be present and available for featuring and/or participating in any and all the activities relating to the Program as and when whenever required by the Company/Producer. 9. The Company/Producer reserves the right, without any earlier notification, to amend/change this rules and regulations including change the Registration Period, choose different modes (other than the mode stated above) to invite registrations, vary the methods of inviting entries including reduce/increase the various modes of registrations, the manner/methods of making public announcements etc. It is the responsibility of the participant(s) to check the rules and regulations www.ndtvimagine.com. 10. At any stage during the Program the Applicant(s), if required by the Company and/or Producer, may have to undergo all the medical tests as prescribed by the doctors so appointed by the Company/Producers. If any Applicant(s)/ participant(s) are shortlisted for further rounds of selection but are found to be medically unfit or unsuitable to further participate due to the unique nature of the Program, then the Company and/or the Producer shall have the right to reject the Applicant(s). 11. The Company reserves the right to cancel/withdraw this Program or cancel any activities relating to the Program without any prior notification to the users, viewers or public in general. Further, Company also reserves the right to not produce or broadcast or exploit the Program, without any prior notification to the Applicant(s) or their family members or any third party. 12. Non-conformance by any Applicant(s) and/or Shortlisted Participant(s), of the rules will disqualify the participant(s) and/or the final participant/Applicants from further participation in the Program immediately, as the case may be. Company/Producer has the sole option to disqualify the Applicant(s) and/or the Shortlisted Participant(s). 13. The Company shall continue to be the sole, exclusive worldwide, perpetual owner of Program and/or activities relating to the Program including the participation of the Applicant(s) or his/her family members/acquaintances in the Program. All intellectual property rights including the entire works whether edited or unedited all rights, title and interest including any and all copyright and all other allied, ancillary and subsidiary rights across all and any media, medium, technology in connection to Program and/or Format and/or the concept of this Program and/or activities relating to the Program such as this selection procedure, participation of the Applicant(s)/ their interaction with the family members/acquaintance in the Program, the photographs/details submitted by the Applicant(s), absolutely and completely solely and exclusively vests with the Company for worldwide and in perpetuity. The Company shall have the sole and exclusive right to exploit the Program, any material in connection to the Program including but not limited to the footages, audio visual clips, photographs and biographical data of the Applicant(s) and any contents therein, across all and any media, technology, products and services at its sole discretion and in any manner whatsoever including but not limited to dub, sub-title, alter, delete, reproduce, broadcast, syndicate, license, manufacture, sell and/or otherwise distribute goods of all kinds in connection to the Program, which also includes reproducing, depicting faces of the Applicant(s) in the Program etc. 14. By participating, it shall be construed that the Applicant(s) have undertaken to hold harmless the Producer, the Company, and/or its affiliates and/or group companies and/or their employees, officers or any other person in relation to any injury/damage/harm/loss suffered by the participant(s) while participating in the Program. Further, the Applicant(s) agrees to indemnify and keep indemnified the Producer, the Channel, the Company and/or its affiliates and/or group companies and/or their employees, officers or any other person against any claims, notices, suits etc. initiated against them on account of the memories and events visualized by the participant. 15. Neither the Producer/Company nor its employees shall in any manner whatsoever be responsible and/or liable in any manner whatsoever, for any physical injury, death, mental trauma caused to the Applicant(s) or any person related to them, for participating in the Program and/or in connection thereto. 16. Employees and/or relatives of the Producer/ Company are not eligible to participate. 17. All Applicants shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Company/Producer in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to Company/Producer herein. 18. The decision of the Company/Producer in connection shall be final and binding on all the Applicant(s). Participation of the Applicant(s) shall be construed that the Applicant(s) has waived his/her right to dispute any decision(s) made by the Company/Producer and that the Applicant(s) agrees to all the decision(s) made by the Company/Producer and that all the decision(s) shall be final and binding upon the Applicant(s) and/or all the Shortlisted Participant(s). 19. Neither the Applicant(s) nor any person related to the Applicant(s) including without limitation the Applicant(s) relative, friends, acquaintance shall disclose or make available to any third party any information relating to the Program, the Company, the Producer, their group companies, their affiliates, their representatives/officers or any other Applicant (s), their family/representative, or any persons related to Program. All information that the Applicant(s) or any persons through the Applicant(s) may have gained access or may have been obtained by the Applicant(s) or any persons through the Applicant(s) in connection to the Program, the Company, the Producer, their group companies, their affiliates, their representatives/officers or any other Applicant (s), their family/representative, or any persons related to Program, shall be considered as confidential or proprietary information/ materials. Neither the Applicant(s) nor any persons related to Applicant(s) including his/her acquaintances shall make any statements of any nature including without limitation statements relating to the Company or the Program or the Company’s operations, its activities, to any third party or the press or any media service. 20. These rules and regulation and/or the participation of the Applicant(s) in the Program shall be governed by laws of India and only the court of New Delhi (India) shall have the exclusive jurisdiction to resolve any dispute that may arise between the Company/Producer or the Applicant(s) and/or any persons related/acquainted to the Applicant(s). |
